Appeals court affirms Newburgh man’s court convictions

GOSHEN – The convictions of Scott Corr following his arrest in the City of Newburgh have been upheld by the Appellate Division of State Supreme Court in Brooklyn.
Corr was found guilty in March 2015 of criminal possession of a weapon and conspiracy. He pled guilty to both counts in Orange County Court.
In his appeal, Corr maintained he had a right to appeal the convictions, but the court discounted that. 
He also attempted to withdraw a previously entered guilty plea, but the appeals court decision said “the decision to permit a defendant to withdraw a previously entered plea of guilty rests within the sound discretion of the court and generally will not be disturbed absent an improvident exercise of discretion.” In this case, the appellate judges wrote that the record demonstrates his guilty pleas “were entered voluntarily, knowingly, and intelligently” and said the county court “providently exercised its discretion in denying, without a hearing, the defendant’s motion to withdraw his pleas.”
