Westchester man charged with stealing over $300,000 in state sales taxes

WHITE PLAINS – A White Plains man was arraigned on Monday on a felony
complaint charging him with one count of grand larceny and two counts
of criminal tax fraud, all as felonies.

Authorities arrested Peter Spagnuolo, 49, after it was determined that
he allegedly committed the offenses between March 1, 2009 and January
31, 2015.

Spagnuolo owned two restaurant franchises at the food court at the Westchester
Mall – the Desert Moon Café and Nathan’s. He was required
to collect state sales tax from customers and remit both sales tax payments
and file sales tax returns.

The investigation revealed he failed to file sales tax returns for either
business, and also did not remit sales tax funds collected by each business.

If convicted, he faces a maximum of five to 15 years in state prison.
