Former Accord man loses appeal of sexual misconduct conviction

KINGSTON – A former Accord man, who was convicted in December 2017 by way of his guilty plea to course of sexual conduct against a child, has lost the appeal of his conviction. Gilberto Ballester-Perez, 40, had been indicted on four counts, but pled guilty to the reduced charge and waived his right to appeal.

In acceptance of the plea agreement, he was sentenced to up to seven years in prison followed by 10 years of post-release supervision.

In his appeal, Ballester-Perez argued his sentence was unduly harsh and severe and that he could appeal the decision.

The Appellate Division of State Supreme Court rejected both arguments.
