WALLKILL – The parents of a disabled 10-year-old daughter thought they had won their case that the Wallkill Central School District failed to provide the proper education for their child when a hearing officer found in their favor. But then, the school district appealed the decision.

The family’s attorney, Gina DeCrescenzo, said the district’s appeal is now before the State Education Department.

In this particular case, while I might not be overly confident normally going to the state review, I am confident in this particular case. Don’t think there is a reasonable, rational mind out there that would disagree with the hearing officer’s very comprehensive decision,” she said.

The attorney for the McKelvey family, which chose not to make their daughter’s name public, said the girl had been verbally and physically abused and deprived of her education.
