Shooter’s conviction upheld

KINGSTON – The Ulster County Court conviction of a man who shot another man in the arm has been affirmed by the Appellate Division of State Supreme Court.
Roy Scippio was convicted in August 2013 of two counts of criminal possession of a weapon.  His conviction stemmed from a shooting in July 2011 in the City of Kingston when Leon Peters was shot in the arm as he walked down a street. Scippio admitted under questioning by police to shooting the victim.
As a prior violent felony offender, Scippio was sentenced to 13 years in state prison followed by five years of post-release supervision.
He appealed the verdict challenging the court’s refusal to suppress his statements to police and attacked the legal sufficiency of the evidence. He also argued that the weapons possession convictions were against the weight of the evidence and he maintained during the prosecutor’s summation, she deprived him of a fair trial and that the aggregate 13-year prison sentence was unduly harsh and excessive.
The appellate court found all of his claims were without merit.
