KINGSTON – A man, who was convicted of beating his father to death
with a baseball bat at his Marlboro home on December 27, 2014, faces 15
years to life in state prison when sentenced in December.
During the trial of Nicholas Pascarella, Jr., his lawyer argued he committed the homicide while under the influence of extreme emotion disturbance, therefore he committed the lesser crime of manslaughter.
The prosecution countered by offering proof to establish that the murder was premeditated. The proof included recorded jail calls between the son and his wife during which he discussed the planning of the murder.
The jury deliberated only two hours before finding Pascarella guilty.
