Confirmation of Dutchess elections commissioner not a slam-dunk

POUGHKEEPSIE – Typically when the Democratic or Republican committee submits a name to a county legislature for an elections commissioner, it is merely a formality for lawmakers to confirm the appointment. But in committee Thursday evening, not all Dutchess legislative Democrats supported the reconfirmation of Democrat Commissioner Marco Caviglia.
Legislator Joel Tyner had concerns, among them the hours he puts in on the job as an attorney.
“I have known Marco Caviglia for many years,” Tyner told members of the legislative committee.  “He is a good man, an honest man, a hardworking man. I would like to see him working hard nine to five, 40 hours a week at [the Board of Elections office] as a Democratic elections commissioner. Forty times in the last year or two he has been at court as a lawyer.”
Tyner also noted that Caviglia’s current term does not expire until the
end of the year, therefore there is no need to reconfirm him now. But, the
legislature’s attorney, Scott Volkman, pointed out that by state law,
since the Democratic committee has voted Caviglia for a new term now, county
legislators have 30 days in which to take action on his confirmation.
