Judge to consider fate of 48 ballots in Benson-Perrello Sullivan County race

MONTICELLO – Attorneys for Sullivan County Legislator Gene Benson and challenger Joseph Perrello, Sr. must submit briefs on Monday as the ballot counting continues in the race for that seat.  
Both sides were in State Supreme Court on Friday with Justice Michael McGuire setting aside 48 ballots.  Many of the ballots in question were cast by students attending Sullivan County Community College. 
Once he reviews arguments from attorneys for both sides, the judge is expected to rule on whether the ballots may be included and if so, they will be opened and counties on Wednesday.
As of the current vote tally, Democrat Benson leads Republican Perrello by about a dozen votes.
