One guilty in “Home” night club shooting; hung jury in another case

KINGSTON – An Ulster County Court Jury has convicted one of the
men involved in the “Home” night club shooting in New Paltz
in January of last year of felony criminal possession of a weapon. The
trial of another man ended in a hung jury.

Police were called to the facility on Route 9W for a report of shots fired
and found one man wounded by a gunshot. He had collapsed in the parking
lot.

The latest trials resulted in a conviction and hung jury, said Chief Assistant
District Attorney Michael Kavanagh.
The officers stopped a fleeing vehicle about a mile from the nightclub
and recovered two guns. The driver was shot by a cop when he reached for
a gun in an effort to point it at an officer, Kavanagh said.

Four men, Tahmel Gordon, Jaquan Higgs, Frederick Smith and Dimetri Moseley,
all of Poughkeepsie, were apprehended in the car driven by Gordon.

Frederick Smith, 25, was convicted of criminal possession of a weapon
as a felony. He has an extensive criminal history on drug and assault
charges.

Moseley’s trial ended in a hung jury and Kavanagh said he will be
retired.

Gordon pled guilty earlier and is in prison.
