Convicted sex offender loses appeal

KINGSTON – A man, who was 22 at the
time he had sexual contact twice with a girl under the age of 13, has
had the appeal of his conviction turned down.

Terrance Toback was convicted in June 2013 when he pled guilty to the
offense of felony criminal sexual act. As part of the plea he waived his
right to appeal.

He was sentenced in Ulster County Court to five years in state prison
and 15 years of parole.

On appeal, Toback argued his waiver of appeal and guilty plea were not
knowingly, voluntary and intelligent. He also claimed he was denied meaningful
representation, but the Appellate Division of State Supreme Court rejected
his claims.
