Man convicted of brutally raping and strangling his wife loses appeal

NEW CITY – A Brooklyn man convicted in Rockland County Court in August 2019 of brutally raping his wife in Spring Valley, lost the appeal of his conviction and sentence.

Holger Lema-Yaucan, 34, was convicted of rape, sexual abuse, strangulation, aggravated criminal contempt and endangering the welfare of a child.

At the time he attacked his wife forcibly engaging in sex, he strangled her and punched her in the face several times.

His two young children were in the room during the violent sexual assault.

He was sentenced to 10 years in prison and 20 years of post-release supervision.

Lema-Yaucan appealed his conviction and sentence in the Appellate Division of State Supreme Court and in a March 2 decision, the court upheld both.

The justices found that the evidence was legally sufficient to find him guilty of the charges
