POUGHKEEPSIE – Former Marist Men’s Volleyball Coach Richard Kelly was sentenced to prison on Monday.  Dutchess County Court Judge Jessica Segal had accepted Kelly’s guilty plea to 10 counts of unlawful surveillance on December 7, 2021.

Kelly had admitted to using a cell phone to film the genitalia of 16 different athletes while they were in the locker room at Marist College.

On Monday, February 14, Kelly appeared in court to learn of his sentence. He was given the opportunity to address the court and read an eight-page letter expressing his remorse for his actions.  “I apologize to each and every victim and their families,” Kelly said.  He noted that he “crossed boundaries and broke trust,” and said, “For that, I am deeply sorry.”

Judge Segal declared that “Cases like this are heavy because there is so much that comes from a violation of trust in a sacred place (referring to the locker room).”  Before ordering the prison sentence, Segal admonished Kelly, saying “You violated their trust.”

The judge issued a sentence of one-to-three years for the first two counts, to run consecutively, and one-to-three years in prison for each of the eight remaining counts.  The sentencing for the eight counts is to run concurrently, meaning that Kelly is slated to serve a total of two-to-six years in state prison.
