Appellate court reduces prison sentence in rape conviction

POUGHKEEPSIE – A former Poughkeepsie man who is serving a 46 ½ year state prison term for his convictions of raping an underage girl four times, will see his prison time reduced following a Supreme Court Appellate Division review.

Walter Mayorga, now 56, was convicted in August 2015 of three counts of rape and endangering the welfare of a child.

He was sentenced to 25 years in prison and 10 years of post-release supervision on one count of rape, a consecutive term of 20 years in prison plus five years of post-release supervision on a second rape count a consecutive term of 1 ½ years plus three years of post-release supervision on the third rape count, and a concurrent term of one year in prison on the charge of child endangerment.

Mayorga had been convicted of forcing a 14-year-old to have sex three times in 2012 and had sex with her again when she was 16.

In his appeal, he maintained his sentence was excessive and the appellate court ruled the sentences should run concurrently, meaning Mayorga will serve a total of 25 years instead of the 46 ½ to which he was initially sentenced.
