Jury acquits Newburgh man of attempted murder

GOSHEN – An Orange County Court jury deliberated for only an hour before returning a not guilty verdict in the attempted murder trial of Walter Herring.
The Newburgh man had been charged in a five-count indictment in connection with the March 4 early morning shooting of another man at the 411 Lounge on Broadway in Newburgh.
The prosecution in the case presided over by Judge Craig Steven Brown charged that Herring, 37, provided the shooter with a gun. But, Herring’s attorney, Rory Brady, maintained that while his client was there, he had no involvement in the crime.
The jury concurred and cleared Herring of all charges.
“What I believe makes our system unique compared to almost any other system in the world is that defendants are given an opportunity to have their case presented to a jury of their peers… and I believe a cross section of our community is best suited to decide what justice is as it relates to the community they reside in, and I think that was the result today,” Brady said.
Had Herring been convicted of the top charge, he could have been sentenced
to over 20 years in state prison.
Herring’s co-conspirator, Antoine Johnson, 25, of newburgh, was sentenced
in November to 18 years in prison andfive years of post-release supervision.
He admitted he illegally possessed a loaded handgun, which he filed several
time at a vehicle being driven by the victim, striking him in his elbow.
Johnson admitted to attempting to kill the victim at the time he fired
at him.
