Appeals court upholds drug conviction

GOSHEN – A man convicted
on two charges of criminal sale of drugs has had his convictions affirmed
by the Appellate Division of State Supreme Court.

On July 15, 2016, Anthony Smith pled guilty to two separate indictments
for criminal sale of a controlled substance in exchange for a promised
sentence of concurrent terms of four years in state prison and two years
of post-release supervision.

He was ordered back to court on August 31, 2016, but did not appear until
September 9 when the court imposed an enhanced sentence of two concurrent
term of six years in prison plus three years of post-release supervision.

On appeal, Smith claimed his enhanced sentence was illegal imposed and
excessive.

The Appellate Division, Second Department, dismissed his arguments and
affirmed the ruling of then-Orange County Court Judge Nicholas DeRosa.
