No charges against driver in double fatal pedestrian accident

POUGHKEEPSIE – State Police have concluded their investigation
into the truck-pedestrian accident that claimed the lives of a mother
and her 10-month-old baby Sunday night and there will apparently be no
charges filed against the driver.

Troopers said the driver, Robert Mahone, 53, of Fishkill, who remained
at the scene right after the incident, was not speeding, was not impaired
by drugs or alcohol nor was he issued any vehicle and traffic citations.

At about 8:40 p.m. on Sunday, Zuleyma Lopez, 28, was crossing Route 52
in the Town of Fishkill with her infant son, Abel Torres-Lopez, and three
other children, when the truck struck them.

Mother and child were both pronounced dead at the scene. The other three
children were taken to the hospital for treatment.
