NEW YORK – Construction of the Millennium gas pipeline to the CPV power plant in Wawayanda may not commence immediately. The US Court of Appeals Second Circuit in New York Thursday issued a stay on construction activities until a hearing can be held by a three-judge panel.
The Federal Energy Regulatory Commission last week granted permission
for the pipeline construction overruling the state, which wanted more
information about potential harmful impacts.
Now, the federal court issued the stay, which is good news to Pramilla Malick, leader of Protect Orange County, the grassroots group fighting the power plant project.
“The state made very strong arguments in their initial stay application and if the court understands the gravity of the imminent harm, then absent undue political influence, I don’t see why the court would not protect the due process rights of the State of New York,” Malick said.
No date has been set to hear the stay, but pipeline company officials were hoping to start construction on the lateral immediately.
