NEWBURGH – By a three-three vote, a proposal to ban the use of sparkling devices during certain times of the year failed at Monday night’s Newburgh City Council session.
Opponents said those devices are fire hazards and could burn those who use them as well as potentially set buildings on fire.
Other council members, including Hillary Rayford, backed their use.
“You can’t take away everything from the community, and as we had previously talked about, the dates of the Fourth of July celebration,” Rayford said. “Why even have it? You can’t take away everything from the community.”
Cities can opt out of the state law allowing sparkling devices. Middletown lawmakers voted to ban their use.
