KINGSTON – An Accord man, who was involved in a fatal head-on crash
on Route 209 in the Town of Marbletown back on April 3, has been indicted
by an Ulster County grand jury.

Shannon Penny, 40, was charged with vehicular manslaughter and vehicular
assault, both as felonies, criminal possession of a controlled substance
as a misdemeanor and a violation of unlawful possession of marijuana in
connection with the death of Leanne Warren, 78.

She was a passenger in a car driven by her husband, Frank Warren, 81,
whose car was struck when Penny’s vehicle crossed into the opposite
lane of traffic on Route 209, striking the Warren vehicle.

Mrs. Warren died of her injuries at the Kingston Hospital. Mr. Warren
sustained serious injuries and is still recovering.

Toxicology results obtained from a blood sample from Penny showed that
at the time of the crash, he was under the influence of marijuana and
prescription medication.

State Police were assisted at the scene of the crash by the Ulster County
Sheriff’s Office, Town of Hurley Fire Department, Town of Marbletown
Fire Department and Rescue Squad, Spring Lake Fire Department and Mobile
Life Paramedics.
