Commercial waste hauler charged with fraud and theft

WHITE PLAINS – Three people have been arraigned on a felony complaint in Westchester County Court charging them with grand larceny and scheme to defraud, both as felonies.
A.T.N.M. Corporation of Briarcliff Manor, a company licensed to haul solid waste in Westchester County and other adjoining areas, is owned and operated by Christopher C. Leggio, 56, of 12 Quail Lane in Brewster, with the assistance of Christopher E. Leggio, 20, also of 12 Quail Lane in Brewster and Stephen DiSalvo, 58, of 130 Woodside Avenue in Briarcliff Manor.
It is alleged that over a 2 ½-period from January 1, 2013 to November 24, 2015, they systematically and falsely altered several hundred dumping tickets to fraudulently reflect a higher tonnage of solid waste being transported,
The false dump tickets were submitted to a solid waste hauling broker who contract with the company. As a result of the scam, the broker paid several hundreds of thousands of dollars to the defendants for work never performed based on those false tonnage entries on the fraudulently altered dump tickets.
The broker negotiated garbage hauling contracts with several different commercial establishments including A&P supermarkets. The broker unknowingly passed along those falsely inflated invoices to A&P and other commercial customers, who then paid the false invoices.
Larger customers like A&P used A.T.N.M. to haul solid waste for 27 A&P stores, 24 of which were in Westchester County.
Bail was set at $50,000 cash or $500,000 bond for both Christopher C. Leggio and DiSalvo. Bail for Christopher E. Leggio was set at $10,000 cash or bond.
They each face up to 15 years in state prison if convicted of the charges.
The investigation is continuing.
