Alderman Will lives in Kingston, says his attorney

KINGSTON – Despite a Chapter 11 bankruptcy filing that says Kingston Alderman Brad Will lives in Bearsville, not Kingston, his attorney said on Monday that paperwork was “filed hastily, in emergency, almost on the eve of a foreclosure sale.”
The attorney, David Waltzer, said Will “was attempting to protect a former marital residence (one that is still relied upon by his former spouse) from foreclosure.”
Waltzer said the bankruptcy schedules filed in this particular case were “virtually blank, as is often the case for ‘emergency filings’.”  The attorney said Will’s “mailing address, where he has lived and collected mail for five years, and where he continues to reside, is in fact in Kingston.”
Waltzer suggested “there are folks who seek to embarrass Mr. Will for seeking bankruptcy relief.” He noted there are “hundreds of thousands of financially responsible and ethical Americans (who) file for bankruptcy every year.” He attributed the need to file to a real estate crash, or divorce, or a failed business, medical situation, protected unemployment or a number of other situations beyond a person’s control.
Will, meanwhile, who was levied a $1,000 fine by the city’s board of ethics, said he has paid it in full.
