Clarkstown cop wins appeals disability claim denial

NEW CITY – A Town of Clarkstown police officer, who filed for disability coverage for an on-the-job injury and had that request denied, will now receive benefits.
Robert Lynn had reported that on July 3, 2012 he was on patrol duty when he fell and was injured while walking to his patrol vehicle.
The police chief and town police commission denied his application for benefits and on July 12, 2013, a Rockland County Supreme Court justice granted his petition and annulled the town determination.
The town later appealed that decision to the Appellate Division, which
now affirmed the lower court’s ruling stating that the Supreme Court
“properly found the petitioner was injured in the performance of
his duties and that the denial of [the state law granting disability payments]
was arbitrary and capricious.”
