KINGSON – A Kingston man, who was convicted in April in Ulster
County Court to sexual abuse and strangulation, was sentenced on Wednesday
to 25 years to life in prison as a persistent felony offender.
The present felony convictions are the fifth for Troy Swartz, 45, of 121
Clinton Avenue in Kingston.
Under state law aimed at protecting society against recidivist felony
offenders, Judge Donald Williams threw the proverbial book at him. Typically,
felonies for which Swartz was convicted would have gotten him a maximum
sentence of seven years, but District Attorney Holley Carnright asked
the court to sentence him as a persistent felony offender in light of
his criminal past.
The most recent convictions stem from an incident of sexual assault and
strangulation of a 27-year-old woman who reported to Kingston Police on
January 8, 2014, that a man she did not know broke into her apartment
on Henry Street in Kingston where Swartz choked and beat her and tried
to rape her.
The victim fought back and scratched the much bigger Swartz. Following
the assault, Swartz took the victim’s money and other personal items
before leaving her apartment.
The woman immediately roused a neighbor who called 911. Troy was arrested
after a DNA match.
Carnright said Swartz is “a present and extraordinary danger to
the residents of Ulster County based on what he has done and continues
to do, therefore he deserves the sentence he has received.”
