Court rules Birchwood Village must pay back PILOT

KINGSTON – A recent State Supreme Court ruling found that Birchwood Village LP in Kingston must pay property taxes on the assessed fair market value for the years under its Ulster County Industrial Development Agency payment in lieu of taxes.
The owners challenged that in court filing a tax certiorari proceeding, but the judge denied that.
Kingston Mayor Shayne Gallo is pleased with the court’s ruling.
“Supreme Court Justice Richard Mott ruled back in December that they must actually be assessed accordingly for the terms of the PILOT and not the section of the law that he tried to avail,” Gallo said.
The mayor said Birchwood owes about $250,000 in back taxes but they may not be paid just yet. Gallo said he believes the project owners are planning to appeal the decision to the state’s highest court.
