FedEx driver convicted of sex crime released from prison after 70 days; victim files civil suit

POUGHKEEPSIE – Joshua Ginyard, 33, gained national attention after he was arrested for raping underage girls in his FedEx delivery van in Millbrook, Dutchess County in 2021.  He was charged with two counts each of rape, criminal sexual act, and disseminating indecent material to a minor, all felonies, and a misdemeanor charge of forcible touching.

Former Dutchess County District Attorney William Grady’s assistant prosecutor allowed Ginyard to plead guilty to one count of felony criminal sexual act and three charges of endangering the welfare of a child and he was sentenced to one-and-a-half years in prison.  He arrived at Altona Correctional Facility in October 2023 and was paroled 70 days later, on January 3, 2024.

The oldest of the three victims on the August 2021 day was 16 years old when Ginyard allegedly picked her up along with two other girls, ages 15 and 13, in his FedEx delivery van, took them with him as he made two deliveries before parking in a secluded area and allegedly raped the 13-year-old while the other two girls watched.  Following that, according to legal documents, he then forced the 16-year-old to perform oral sex on him before he would drive them back into Millbrook and release them.

The plaintiff, whose name has been withheld, filed a civil lawsuit against FedEx, Dutchess Parcel Service Inc., and Ginyard in Dutchess County Supreme Court this week.  The victim resides in Dutchess County and Ginyard, following his release from prison, lives in the Town of Poughkeepsie.

According to the civil complaint, the oldest victim is suing FedEx, Dutchess Parcel Service Inc., and Ginyard for damages alleging negligence, gross negligence, and recklessness in the rape, sexual assault, forcible imprisonment and intentional infliction of emotional distress of the plaintiff, who was a minor at the time of these alleged crimes.

In a statement, the plaintiff’s attorney, Kathryn Collins, said: “Our client has suffered the most horrific violation a child can experience at the hands of a predator. We brought this lawsuit to pursue a modicum of justice for a young girl who was forced to have sexual intercourse in front of her younger sister. At the same time, we seek to hold the corporate defendants accountable for their carelessness in allowing this predator to roam the streets of our communities, endangering our children.”

As the case winds through the motions, Collins added that it will further impact her client.  “Our client will now have to relive these horrors through testifying at both a deposition and trial, which will only increase the damage already caused. However, that is our system of justice. We will continue to advocate for her with the hope that she can have some closure and move beyond these tragedies of her childhood.”
