KINGSTON – Fifty-year-old Daniel Foy of Kerhonkson was arraigned in Ulster County Court on Friday after being indicted for allegedly killing and dismembering a woman known to him on Easter weekend (March 31-April 1).  Foy had been arrested on April 3 by the Ulster County Sheriff’s Office after a search warrant was executed at his residence and other locations.

The indictment, handed down last week, alleges that between March 31 and April 1, Foy murdered Alberta Dale, 44, of Scranton, Pennsylvania, dismembered her and was in the process of disposing of her body when law enforcement intervened.

Ulster County Sheriff Juan Figueroa responded to the call on Easter weekend and described it as a “horrific event” that showed a “total disregard for human life – absolutely horrible.” He added, “What happened to the victim was horrific and cruel and will not be tolerated in our community.”

Ulster County District Attorney Emmanuel Nneji issued a statement saying, “This case showcases in one person the evil of domestic violence.  Let there be no speculation about mental health, as often happens – this was a pure exhibition of evil.  The total disregard for the life and dignity of another person is at the heart of domestic violence; Damon Foy has shown us that.”

Foy, a convicted felon who previously spent 18 years in prison, is charged with murder, aggravated criminal contempt, concealment of a human corpse, criminal contempt, criminal mischief, assault, criminal obstruction of breathing or blood circulation, and criminal possession of a weapon.

The Ulster County Sheriff’s Office became involved in the investigation on April 1 after receiving a call from the Scranton, PA Police Department that asked the sheriff’s office to do a welfare check on Alberta Dale.  Scranton police said Dale’s family was concerned and believed she was with Foy.  Sheriff’s deputies responded to Foy’s residence and he allowed them in to search for Dale.  The search was unsuccessful.

On April 2, a member of the public alerted the sheriff’s office to evidence discovered on the side of a road in the Town of Wawarsing.  The property was turned over to the sheriff’s office, which was investigating Dale’s whereabouts and the possibility foul play being involved.  Search warrants were obtained for Foy’s residence and other locations.  At Foy’s residence, evidence of Dale’s murder and dismemberment were recovered.

Additional remains of the victim were recovered in the Town of Marlboro on April 3 and Foy was arrested, arraigned, and remanded to the Ulster County Jail a short time later. Following Friday’s arraignment in Ulster County Court, he was remanded to the Ulster County Jail without bail.

Foy had been arrested on domestic violence charges in January that involved the victim.  He was sent to the Ulster County Jail on $5,000 cash bail, $10,000 bond, or $40,000 partially-secured bond, which he posted to get out of jail.  A temporary restraining order had been granted to Alberta Dale at the time of Foy’s original arrest.
