Letter to the Editor: Swan Lake EPA report says plant is in violation

Dear Editor,

The full compliance order from the EPA to the Town of Liberty has been released and it is sixteen pages.

The report indicates that the Town of Liberty’s Swan Lake Sewage Treatment Plant is in violation of the
US Federal Clean Water Act (CWA) Sections 301 and 402; Docket Number CWA-02-2023-3047 as of September 14, 2023.
These are serious violations.  Page 3 Section 8 a-b specifically states that the US EPA conducted an inspection on July 10, 2023 of violations and indicated that, “At the time of the inspection, the plant operator stated that the Town does not have the means to conduct enforcement action against known violators throughout the Town.”
Currently the Town of Liberty is advertising for two plant operators.
It is unbelievable after everything we’ve been through with rampant overdevelopment in this Hamlet of 300 residents, that the Town Board wants to double down and push through an ill-conceived, flawed and incomplete Planned Unit Development (PUD) application of 180 residential units on the shores of Swan Lake.
We can’t risk the waters of Swan Lake, which flow into the Mongaup and Delaware River Basin to be contaminated by rampant overdevelopment, especially with this non-compliant 180 unit PUD application in front of the Liberty Town Board right now.
