Is Gambling Legal in California?

In California, several types of gambling are permitted. That is because the California Constitution prohibits some gambling activities. But this comes with an exception, which includes the California State Lottery, casino gambling on federally acknowledged Indian tribes’ territory, games in licensed card rooms, charitable raffle and bingo games, and horse race betting.

Several other games are not outlawed by California law.

The California Penal Code 330 PC criminalizes particular games, such as banking and percentage games. Banking games are those in which a “house” or a “bank” plays. During the game, the bank collects money from the losers and gives it to the victors. Percentage games are ones in which the “house” earns money based on the amount won.

But maybe you are wondering, is online poker legal in California? The answer is no. Although online gambling is generally illegal, you can still participate in other legal gambling games stated to win prizes.

Californias Famous Gambling Activities

Although California has several legal gambling options, only certain gambling activities are permitted in California under existing state law. Considering that, below are some of the legal gambling activities allowed in the state.

The Tribal Casinos

The federal Indian Gaming Regulatory Act 5 allows legally recognized Indian tribes to manage casinos on their tribal property. In California, there are 63 current licensed tribal casinos. And since these casinos are all operated by the Native American Tribes, they have strict laws. You cannot enter the casinos if you haven’t reached the legal drinking age of 21 since most tribal casinos offer liquor.

California’s Card Rooms

The California Gambling Control Act of 1998 establishes regulations for cardroom operations. With that, California has 88 licensed cardrooms. California card rooms allow their players to operate as a dealer at each table instead of acting as a house for games, which is usual for tribal casinos. Additionally, cardrooms don’t offer banked games or slot machines, but they offer various table games, like poker.

Lottery in Golden State

The lottery in California combines traditional drawing games and a large selection of scratch-off tickets. Aside from that, it not only offers its players an opportunity to win awesome prizes but also helps the state in certain ways. Like, all ticket sales will go to funding education programs in California. Generally, California’s colleges, universities, and public schools will benefit from this.
