DA may look at school district case against Padilla

NEWBURGH – The Board of Education of the Newburgh Enlarged City School District has yet to come to terms with suspended Superintendent Roberto Padilla for his termination or retirement over allegations that he violated federal law by sexually harassing female employees. But, if and when that occurs, Orange County District Attorney David Hoovler said he would take a look at the case.

Two independent private investigators knowledgeable in the field of sexual harassment, have concluded that Padilla did break the law.

Hoovler, who has not been asked to look into the matter, said if requested, he will review it.

“If and when the school district has completed its investigation and it is done and they refer it to the district attorney’s office, we will gladly take a look at it for potential charges. We have not reached that point yet. I have not had any direct contact with the school district regarding this; however, I have been told that when it is complete, we may be contacted,” Hoovler said.

At least one member of the school board, acting as a private citizen, has urged the DA to take a look at the case. One lawyer, though, said since United States laws were allegedly broken, it may be something for federal prosecutors to explore.
