Man gets lengthy prison sentence for Poughkeepsie shooting

POUGHKEEPSIE – Dutchess County Court Judge Edward McLoughlin sentenced a Rhinebeck man to more than 20 years in prison on Friday for his role in the February 2020 shooting of a teenager on Garden Street in Poughkeepsie.

Twenty-one-year-old Carl Hannans, a former Poughkeepsie resident, had previously pled guilty to one count of attempted murder, one count of assault, four counts of attempted robbery, and three counts of criminal possession of a weapon.

Three weeks before sentencing, Hannans had fired his attorney and replaced him with Kelley Enderley, a Poughkeepsie-based lawyer.  Enderley listened intently as McLoughlin described Hannans’ actions as a “Cowardly ambush that maimed a young man.”  The judge added, “You gave the victim a life sentence without the use of his arm.”

The victim had sustained a gunshot wound to the arm and police had to apply a tourniquet at the scene to prevent him from bleeding out.

“We are deeply disappointed with the sentence of the court today.  Carl is a 21-year-old who believed he was being robbed and pleaded to an open indictment because he had a breakdown in the relationship with his prior attorney before and during the plea,” Enderley said.

John Peterson, a Newburgh resident, had also been arrested in the Garden Street shooting and was recently acquitted on all charges by a Dutchess County jury.  Citing the recent acquittal, Enderley said, ” We do not agree with the Judge’s interpretation of the evidence for a co-defendant that was actually acquitted at the time of trial.  It is our intention to file an appeal of this matter.”

McLoughlin sentenced Hannans to 23 years in prison for the attempted murder, 23 years for the assault, 15 years for each of the four counts of attempted robbery, and 15 years for each of the three counts of the weapons charge.  The sentences will run concurrently and Hannans will be subject to five years of parole.

While Hannans was out on bail for the charges related to the Garden Street shooting, he was arrested by City of Poughkeepsie police for the April 2021 murder of Evan Davis at the MLK housing complex in the city.  He is still awaiting trial on that murder charge.
