Appeals court rejects challenge to sex act conviction

GOSHEN – A man convicted of a criminal sexual act based on his guilty plea in Orange County Court, had his appeal denied by the Appellate Division of State Supreme Court.

James Brown appealed the denial, following a hearing, of his effort to suppress his statements to law enforcement officials.

“The county court properly denied that branch of the defendant’s omnibus motion which was to suppress his statements to law enforcement officials, because he was not subject to interrogation,” the June 23 appeals court decision stated.
