Ulster IDA wins court battle over Kieffer Lane financial assistance

KINGSTON – The Appellate Division, Third Department, of State Supreme Court has ruled that the Ulster County Industrial Development Agency had the right and did legally refuse to provide financial incentives to 2-4 Kieffer Lane, LLC, a company that wanted to locate a tower crane business in the county.

Kieffer sued the IDA after the board declined to approve the incentives for the business headed for the Town of Ulster.

“It’s simply not enough for a proposed project to apply and qualify for exemptions and IDA benefits; inducements are discretionary and a project must actually benefit residents of Ulster County as outlined in the IDA statute,” said Board Chairman Randall Leverette.

The appellate court concurred with the IDA that there was no demonstrated need for tower cranes in the county, therefore granting financial incentives would have no benefit for county residents.

The court also ordered Kieffer to pay the IDA’s attorney fees.
