Appeals court upholds armed robbery conviction

WHITE PLAINS – The Appellate Division of State Supreme Court Second Department affirmed the conviction of a man found guilty in a non-jury Westchester County Court trial of two counts each of armed robbery, assault, criminal possession of a weapon as well as attempted robbery.
Michael Thomas, also known as Laquan Smith, was arrested for an attempted robbery in which he brandished a knife and a separate robbery in which the victim was stabbed.
The victim of the attempted robbery identified him in a show-up procedure some three hours after the crime and the victim who was stabbed during the robbery identified him from a photographic array that was shown to him at the hospital.
In Westchester County Court, Thomas sought to suppress both identifications, but that was denied.  He appealed that decision to the appellate court, which affirmed the lower court’s ruling.
