Anti-CPV group urges retrial of Percoco co-defendant

WAWAYANDA – The Protect Orange County group, which has been fighting to keep the CPV power plant from operating, is calling on the US Attorney for the Southern District of New York to retry Joseph Percoco’s co-defendant Peter Galbraith Kelly, whose case ended with a mistrial.
Percoco, a former aide to Governor Cuomo, was found guilty, but in Kelly’s case, the jury was deadlocked.
In a letter to Janis Echenberg, deputy chief of the Criminal Division of the US Attorney’s Office, Malick urged her office to “conduct a more thorough investigation of both Kelly and Competitive Power Ventures. Based on our communications with many other communities approached by Kelly, the evidence presented during the trial demonstrates a pattern of behavior by both.”
Malick said her organization believes that “further investigation can provide greater evidence supporting the charges against Kelly.”
On Wednesday, Judge Caproni granted a request by federal prosecutors for an extension of the time to decide on whether to retry Kelly to April 25. Malick said Protect Orange County “is concerned by this delay and the lack of an expeditious decision to retry.”
