Orange County lawmakers consider move to kill CPV

GOSHEN – The Orange County Legislature will consider a resolution urging the state legislature and governor to pass a measure to create a presumption of invalidity for any project in which criminal conduct by public officials occurred and for which permits were issued.
The local move is in direct response to this past week’s federal conviction of Joseph Percoco on bribery charges related to the CPV power plant in Wawayanda. Percoco was a one-time aide to Governor Andrew Cuomo.
The county resolution says that any state legislation that would be adopted must be retroactive and apply to the CPV project.
Opponents of CPV said local, state and federal approvals for the facility were rushed through without appropriate considerations.
The plant is completed, has been tested and is awaiting installation of a natural gas pipeline lateral to fuel it. Recent testing used diesel fuel, which created a widespread plume of particle-laden steam across a several-mile area.
