NEWBURGH –The Worker Justice Center of New York, based in Kingston, has filed a lawsuit in US District Court for the Southern District of New York to recover unpaid wages for Marlon Aguirre of Newburgh.
Aguirre alleges that Torino Pizza, doing business as Stella’s Pizzeria in Newburgh, violated the Fair Labor Standards Act and New York Labor Law by failing to pay him legally-required overtime wages and committing other statutory violations.
Aguirre, who worked as cook at Stella’s for over 13 years, claims he regularly worked long hours – as many as 70 or 80 per week, yet he was never paid overtime at time-and-a-half of his regular hourly rate.
“I bring this lawsuit because all workers should be treated equally – employers cannot force certain people to work extra hours without overtime pay. It doesn’t matter where you come from or what you look like, employers need to treat all workers the same,” Aguirre said.
