Appeals court upholds robbery, sexual abuse conviction

WHITE PLAINS – The Westchester County Court conviction of a man on charges of robbery, sexual abuse, grand larceny, attempted rape, attempted sexual abuse and criminal obstruction of breathing has been affirmed by the Appellate Division of State Supreme Court, Second Judicial Department.
The appeals court said the hearing court properly denied the motion by defendant Frank Polancobatista to suppress statements he made to police in a patrol car after his apprehension, but before Miranda warnings were given since those statements were spontaneous and not the result of interrogation.
Polancobatista also maintained that his defense counsel was on effective, but the appellate court rejected that argument.
