Lawsuit filed seeking to annul Legoland approvals by Town of Goshen

GOSHEN – Attorney Michael
Sussman, Monday, filed a lawsuit in Orange County State Supreme Court
seeking to have Goshen town approvals for the construction of a Legoland
amusement park annulled.

Sussman filed the suit on behalf of several Goshen residents and the grassroots
group Concerned Citizens of the Hudson Valley on the grounds that the
Goshen Town and Planning boards had violated state environmental quality
review laws in several ways.

? “Failing to do cumulative impact, failing to have the town board
as lead agency for the zoning changes and for the comprehensive plan changes,
adopting an irrational plan, which totally undercut the comprehensive
plan the community had adopted last in 2009, and in other ways,”
he said.

Legoland point man Phil Royle, meanwhile, said his company’s review
process “has been meticulously thorough, fully transparent and has
taken place in public forums in a judicious timeframe.”

He said they “responded to requests to Goshen’s Town Board
and Planning Board, and addressed all comment and questions. During this
detailed review process, we have made significant changes which we are
confident positively responds to all concerns ad requests.” The
outcome is that Legoland New York has been approved, he noted.

“Should the town’s decision on this project go before the
court, we are confident that the outcome will be a positive one,”
said Royle.
