Kingston man convicted of obstructing assault investigation

KINGSTON – An Ulster County Court jury convicted a Kingston man on a charge of obstructing governmental administration.
The case against Fabian Marshall, 27, arose in September 2015. Kingston Police responded to a report of an assault on Broadway. Officers tried to interview Marshall, who was in the same area as the reported assault and matched the description of the assailant.
The District Attorney’s Office said Marshall refused to comply,
became uncooperative and fought with officers. That fight prevented the
police from investigating the assault further.
Citizen Action of New York area organizer Callie Jayne, meanwhile, released a Facebook video on Monday that was a combination of police and cell phone video which shows an officer approaching Marshall, cursing and refusing to tell him why he was being stopped and questioned.
“Never in that video did they explain to the young man that they even thought he was there for,” Jayne said. “When he asked why, the cop said, ‘because I’m talking to you’. In part of the footage you can see he was just standing there, he was just waiting. They didn’t have any reason to believe he was the person. They never told him exactly what it was that they thought he did.”
Kinston Police Chief Egidio Tinto could not be reached for comment on Monday evening.
Marshall will be sentence in January.
