Appeals court upholds Ulster conviction

KINGSTON – The Appellate Division of State Supreme Court affirmed the April 2014 conviction of Ronald Grumberg on his guilty plea to the crimes of criminal possession of a weapon and grand larceny.
In 2013, an Ulster County Sheriff’s Office investigation discovered he was engaged in fraudulent motor vehicle transactions and was selling firearms and ammunition. During a warrant search of his home, police recovered various types of guns and semi-automatic weapons as well as $2,000 in cash.
Following his guilty plea, Grumberg was sentenced to two years in state
prison and three years of post-release supervision for criminal possession
of a weapon and a consecutive two to six years on his grand larceny conviction.
He was also ordered to pay $200,000 in restitution.
On appeal, Grumberg maintained his guilty plea was not knowingly, voluntarily and intelligently entered because he was misinformed about the sentence he would receive and that the 11-month delay between the initial indictment and his guilty plea violated his constitutional right to a speedy trial. He also challenged the $200,000 restitution award and the court’s imposition of a 10 percent surcharge.
The court rejected his claims, but reduced the surcharge from 10 percent to five percent.
