Woman indicted in drunk driving death of Manhattanville College student

WHITE PLAINS – A Rye woman has been indicted on a charge of vehicular
manslaughter in connection with the drunk driving death of a college student.

Westchester County District Attorney Anthony Scarpino, Jr. said it is
alleged that Emma Fox, 26, was driving drunk on Westchester Avenue in
White Plains at around 4:50 a.m. on October 9, 2016 when she struck and
killed 21-year-old Robert Shartner, who was running back to his dorm from
downtown White Plains.

After striking the victim, Fox drove about a half mile before stopping
her car on the shoulder of the road. A passing motorist saw her car had
sustained substantial damage to the windshield and called 911.

Police found the victim unconscious on the side of the road where he was
pronounced dead.

Fox failed standard field sobriety tests. She was taken to the hospital
where she consented to blood and urine tests, which revealed her blood
alcohol content was above the legal limit of .08 percent.

Fox, who was also indicted on two counts of operating a motor vehicle
while under the influence of alcohol, and one count each of reckless driving
and speeding, remains out on bail.

If convicted, she faces 2 1/3 to seven years in state prison.
