Mom charged with vehicular manslaughter in death of her two-year-old son

GOSHEN – A Bloomingburg woman was arraigned in Orange County Court on Tuesday in connection with the death of her two-year-old son.
Nicole Smith, 27, was driving on March 19 when she attempted to pass another vehicle on Route 17K in Montgomery and hit the vehicle she was trying to pass, causing Smith’s car to go off the road, hit an embankment and strike a tree.
Smith’s son was ejected from the car and died.
The indictment alleges that at the time of the accident, Smith was impaired
by Methadone and Alprozolam.
Smith was indicted on charges of aggravated vehicular homicide, vehicular manslaughter, criminally negligent homicide, aggravated operating a motor vehicle while under the influence of drugs and reckless driving.
Bail was set at $250,000 cash or $500,000 bond.
Orange County District Attorney David Hoovler said driving under the influence of prescription medications is as dangerous as driving while intoxicated. “I can think of no more tragic circumstance than a mother killer her son,” he said.
The case was investigated by Town of Montgomery Police with assistance of the Accident Reconstruction Unit of the State Police.
