Mistrial declared in Pascarella murder trial

KINGSTON – The Ulster County murder trial of Nicholas Pascarella,
Jr. ended in a mistrial Friday afternoon. The jury deliberated for 4 ½
days without reaching a verdict and told the judge they were deadlocked.

At 2:35 p.m. on Friday, a mistrial was declared.

Pascarella had been charged with murder for killing his father with a
baseball bat on December 27, 2014 outside the victim’s home.

During the trial, the defense argued that the son killed his father while
under the influence of extreme emotional disturbance and as a result,
committed the crime of manslaughter.

District Attorney Holley Carnright said the jury worked “diligently
to reach a unanimous decision, which was evidenced by the questions they
asked during the deliberations.” He said the jurors’ inability
to arrive at a “universal accord is in no way a reflection of their
efforts.”

The case was prosecuted by Chief Assistance DA Michael Kavanagh and the
Pascarella was represented by MariAnn Connolly.
