Entergy wins leak rate test extension issue

BUCHANAN – The New York State’s challenge to a Nuclear Regulatory Commission decision granting Entergy a five-year extension to the 10-year Integrated Leak Rate Tests at the Indian Point nuclear power plants has been rejected.
Following extensive study, the NRC granted the extension to every 15 years. The State of New York Attorney General’s Office challenged that, but Atomic Safety and Licensing Board rejected the appeal, thus upholding the NRC’s decision.
NRC spokesman Neil Sheehan spokesman said the debate did not end there.
“This issue was considered by a three-judge panel for the NRC – the Atomic Safety and Licensing Board. They denied the state’s challenge of this five-year extension,” Sheehan said. It went to the presidentially appointed commission that oversees the NRC and [Tuesday] the commission upheld the Atomic Safety and Licensing Board and denied the appeal.”
Sheehan noted that the state could always appeal to the federal courts.
