KINGSTON – On his last day as Kingston mayor, Shayne Gallo announced on Thursday that he has filed a State Supreme Court lawsuit against the parties he believes are responsible for “negligence, shoddy design work, poor management and supervision” over the Pike Plan project. He is suing each of the three parties for $1 million.
Gallo said the RBA Group of New York City failed to perform services
for the Kingston Street and Streetscape Project, which included the repairs
and/or reconstruction of portions of the “Pike Plan Portico”
and also perform an assessment of the sidewalks, and complete design work
for all project elements.
He said Lochner Engineering failed to perform architectural/engineering services for the project and Fourman Construction failed to perform construction work, labor and services for the project.
“It is unfortunate the property owners under the Pike Plan have
been treated so poorly as they pay one-quarter of the city’s taxes,”
Gallo said.
Incoming Mayor Steven Noble said it was “inappropriate for me to make a decision, before I have taken office and spoken to all stakeholders.” He said the current administration “has not been in contact with me in regards to any transition process, including current or potential litigation.”
Noble said once he takes office, and “reviewed the associated documents and gathered all of the information necessary, I will communicate what my administration intends to do, based on what is in the best interest of the city.”
