GOSHEN – The Orange County
Legislature is expected to support a measure that would give cities the
right to opt out of the sale of sparklers during certain holiday times.
The state has approved the carte blanche sale and use of those devices.
County Legislator Jeffrey Berkman sponsored the legislation.
The Orange County Legislature’s Physical Services Committee is
supporting giving the cities the right to prevent the use, said Chairman
Kevin Hines.
“We voted yes to allow the cities to opt out of the law,” said Hines.  “Currently they are not allowed to have the right; it’s whether the county is on or out and the county has chosen to be in, but it’s only a memorialization. We don’t have the authority to change the law because the state allows you to opt in or out. We as a county have opted in. So this is just a memorialization to the state representatives to allow cities to opt out as they see fit.”
Orange County’s three cities want the right to decide if they should allow sparklers to be sold.
