Oneida Nation files lawsuit against state Gaming Commission for withholding documents

ONEIDA – The Oneida Indian Nation has filed a lawsuit urging a state court to force the New York State Gaming Commission to release all documents related to its gaming casino siting decisions.
One of the three sites selected is the Empire Resorts facility in Kiamesha Lake.
The Oneidas maintain that despite promises, the gaming commission rejected open records requests for data and documents it relied on when making its decisions. They said the rejection came amid revelations that the process “was plagued by conflicts of interest and a refusal by some bidders to properly disclose key facts about their gaming proposals.”
The Nation said last February the gaming commission said the legislation expanding gaming “called for unprecedented transparency,” but the suit charged the state commission rejected their request under the freedom of information law for the analyses, data and protections that the commission now says it relied on to make its decisions.
