Gallo loses primary attempts

KINGSTON – Kingston Mayor Shayne Gallo,
who was bumped off the September 10 Conservative and Independence Party
primary lines, has lost his court appeal of the Supreme Court decision.

Gallo, who will face Steven Noble in the Democratic primary, also sought
the other two lines, but because mailed in certificates of acceptance
were received past the date set by election law, he was knocked off those
lines.

He challenged the decision in the Appellate Division, contending the envelopes
were stamped by a postal meter machine which constituted filing on time
since the meter stamp was ahead of the deadline date of July 13. The envelopes
arrived at the board of elections with a postmark of September 14.

The appellate court, in an August 20 decision found that “a postage
meter stamp is not the equivalent of a postmark date.”

Whoever wins the Democratic primary on September 10 will face Ronald Polacco,
who will appear on the Republican, Conservative and Independence Party
lines in the general election in November.

Democrats hold a two-to-one edge over Republicans in the City of Kingston.
