Appeal of Jenkins’ removal as mayor may proceed to Court of Appeals

MONTICELLO – The New York State Court of Appeals, through a single judge, has invited response to attorney Michael Sussman’s request for a stay from the four petitioners who sought to remove Gordon Jenkins as mayor of the Village of Monticello.
The response is due on April 27, the same date all parties must make submissions on whether Jenkins may appeal his removal or must seek a grant from the court of the right to appeal.
Sussman said he intends to do that.
The Appellate Division of State Supreme Court recently ordered Jenkins to step down as mayor, which he did earlier this month.
His removal comes as a result of his being convicted of official misconduct and other charges.
