Appeals court upholds Sullivan County Court conviction of child rape

MONTICELLO – The Appellate Division of State Supreme Court has affirmed the convictions of a former Hurleyville man who was convicted of course of sexual conduct against a child and rape as felonies.
Kevin Devault, 55, was sentenced to 25 years in state prison and 20 years of parole after he pled guilty in May 2012.
In his appeal, he maintained his plea was not voluntary and that his wavier of appeal was invalid. The appeals court rejected both arguments.
Devault had admitting to sexually abusing a child between 2000 and 2008 in Sullivan County.
“This defendant and his documented history of sexual deviance presented a clear and present danger to the community and the 25 year state prison sentence, which has now been affirmed by the appellate court, will ensure that this defendant cannot harm another innocent person again.”
